The Italian Cultural Institute in Los Angeles intends to sell, through a public auction, the following service vehicle:

The car is in fair condition (photos in gallery). It is possible to view the vehicle by making an appointment via email at amm.iicla@esteri.it by August 30, 2024.
The vehicle will be sold in its current state at the time of bidding, according to the “seen and liked” formula. The car will be sold without any guarantee regarding the condition of its mechanical components and the Italian Cultural Institute in Los Angeles will not be responsible for any defects. The buyer will not be able to claim any exceptions in this regard.
The buyer will also be responsible for any costs related to the possession and use of the vehicle, based on current regulations (checks, registrations, sales taxes or anything else). The vehicle is currently registered as a diplomatic vehicle.
It will be up to the successful bidder to take care of all the formalities necessary for the transfer of ownership and for any other procedures relating to the use of the vehicle, with payment made in full to the Italian Cultural Institute of Los Angeles.
2. Auction starting price
The starting price is set at USD 5,000.00 (Five Thousand US dollars and zero cents).
3. Auction procedure
a) Bidders are required to send secret offers equal to or more than the starting price.
b) All offers must be received in a closed envelope. The envelope should include on its outside, clearly visible, the subject line: “offer to purchase a car”.
c) The auction, without prejudice to what is provided in the general conditions, will be declared “no bid” if no valid offers are received.
4. Terms of participation
For the purposes of participating in the tender, interested parties must send, under penalty of exclusion, the economic offer by certified mail which shall include the forms “Annex I – Application”, “Annex II – Economic Offer” e “Annex III – Personal Data” to

no later than 4pm on August 30, 2024.
Offers can also be delivered by hand to the aforementioned office from Monday to Friday, from 9am to 1pm and from 2pm to 5pm (proof of receipt will be provided).
The mailing date of the letter will have no relevance. The administration is exempt from any responsibility for the failure or delay in delivery, whatever the cause.
5. Non-admissibility of offers
Proxy offered are not permitted, except in the case of legal representatives of public and private legal entities and companies carrying out entrepreneurial activities. Bids from office employees (and their family members and/or cohabitants) who have decision-making power in the sale process of the property or who have exercised functions in the formation of the value of the property will also not be accepted.
6. Presentation of offers.
Offers must be received within the deadline referred to in point 4, paragraph 3, in a closed envelope as specified above. Envelopes must report on the outside the subject line “offer to purchase a car”. To ensure integrity, envelopes must be closed and countersigned on the closing flaps.
7. Public session to open bids.
The Commission appointed for evaluating bids will meet on September 6, 2024 at 3 pm, in a public session, open only to the competitors who have submitted offers, and will proceed to open the envelopes and analyze the documents provided.
The auction will be won by the person who has submitted the highest offer and even when there is only one valid offer, provided such offer is deemed suitable and adequate.
The price offered must be equal or higher to that indicated as the starting price. Offers lower than said price will not be accepted.
Offers that are conditional or expressed in an indefinite manner or with simple reference to another offer of one’s own or of others are not permitted. The offer must be expressed in figures and words; in case of discrepancy, the most advantageous amount will prevail.
8. In the case of equal offers
In the event that two or more competitors make the same offer, only these, if present, will be invited, using the secret offers method, to formulate a new offer during the same session, provided that they agree to such method. In case a simultaneous presence or lack of agreement for the immediate formulation of new offers, the same competitors will be invited, via email or telephone communication, to submit a new offer within 2 days of the session, with the same methods proposed for the first offer.
Once the envelopes have been delivered, the highest bidder will be declared the winner. If the competitors who have produced the same offer do not agree to increase the offer, or the new offer is once again of the same amount, the successful bidder will be chosen by draw.
9. Contracts
The auction will not have the effects of a sales contract, therefore a deed of sale must be signed in terms that will be communicated after the auction’s end.
10. Conditions of sale
The car is sold in its current condition, in which it is found.
The vehicle will be made available immediately upon signing the sale contract.
11. Obligations of the buyer and the administration
The buyer will be considered responsible for all legal purposes after the signing of the deed of sale.
12. Buyer’s waiver
In case the winning bidder does not show up to sign the sale contract within the communicated deadline, he will lose all his rights. In this case, the Italian Cultural Institute in Los Angeles reserves the right to evaluate to award the auction to the second highest bidder or to start a new procedure.

2. Data processing
The processing of all data received, which constitutes a condition for participation in the auction, will take place only for the purposes referred to in this auction notice and in compliance with Legislative Decree 196/2003 and other regulatory provisions in force.
It is specified that the processing of personal data will be based on lawfulness and fairness, in full protection of the rights of competitors and their confidentiality. The same data will be kept in the records of the Italian Cultural Institute in Los Angeles and of the central Administration for the sole purpose of administrative and accounting control and in any case for a time not exceeding the time necessary for the purposes for which they were collected and processed.
3. Arbitrations
Legal actions will be taken in accordance with the respective Penal Codes against anyone who, with violence or threats or with gifts, promises, collusion or other fraudulent means, prevents or disturbs the tender, or distracts the bidders, and against anyone who abstains from competing for money or other advantage given or promised to him or to others.
4 Jurisdiction
In the event of disputes, the exclusive forum of jurisdiction will be that of Los Angeles.
